Appellate Court Affirms Jury Award of $3 Million in Inverse Condemnation Case

After years of trying to work with the Pleasant Hill School District to alleviate ever-increasing flooding from the District’s property, Jim and Nancy Hull, owners of the adjacent Pleasant Hill Golf Course, sued the District for inverse condemnation. After a week-long trial, the jury ultimately awarded the Hulls $3 million for the property the District had effectively taken for purposes of its storm water management system. The District appealed to the Missouri Court of Appeals for the Western District, which affirmed the jury verdict. The Missouri Supreme Court denied the District’s petition for transfer on October 6, 2017.
